Terms of Service

These terms govern your use of the Tork app and platform, operated by ALFADHA SHOP, a business registered with the Baghdad Chamber of Commerce, Iraq. By using the app you confirm that you have read them and agree to be bound by them. If you do not agree with any part, please do not use the app.
What Tork is
Tork is a neutral classifieds venue where users list motorcycles and spare parts in Iraq, search for them, and contact each other. Tork is not a party to any transaction: we do not buy, sell, inspect, ship or guarantee any item listed. All negotiation, payment and handover happen directly between buyer and seller, off the platform, at their sole risk.
Eligibility and your account
You may use Tork if you can form a binding agreement under the laws of Iraq. If you are a minor under Iraqi law, you may use Tork only with the involvement and consent of a parent or legal guardian, who accepts these terms on your behalf and is responsible for your use. You can browse the app without registering; posting listings, saving favourites, following showrooms and reporting require an account. You sign in with your phone number using a one-time passcode (OTP) delivered over WhatsApp — there is no password. Your sign-in tokens are stored only in your device's encrypted system store (Keychain on iOS, Keystore on Android). You are responsible for everything done through your account and for keeping your device and number secure. Tell us at once if you lose control of your number.
Content standards — zero tolerance
Tork has a zero-tolerance policy for objectionable content and abusive behaviour. You may not post content that is fake, stolen, counterfeit, misleading, illegal, hateful, harassing, sexually explicit, or otherwise objectionable, and you may not behave abusively toward other users. Every listing is reviewed before it goes live, and we may refuse, edit or remove any content — and suspend or ban any user — that breaches these standards. We act on reports of objectionable content or abusive users promptly, typically within 24 hours.
Your listings
You alone are responsible for the accuracy of everything you post: photos, price, condition, mileage, year and any other description. The item must be yours or one you are authorised to sell, and the photos must be of that actual item. By posting content you grant Tork a non-exclusive, royalty-free licence to display, host and resize it within the app and in material promoting the platform. You keep ownership, and the licence ends when the listing is deleted.
Prohibited use
You may not post stolen, counterfeit or legally prohibited goods, misleading or duplicate listings, fake prices, or another person's contact details without their permission. You also may not scrape user data, attempt to disrupt or gain unauthorised access to the service, impersonate anyone, or use the app to harass or abuse another user.
How buyers and sellers connect
Tork is not a social network. User profiles are not publicly searchable or browsable, and your name and profile details are not displayed to other users across the app. When someone wants to enquire about a listing, tapping "Contact" opens a direct WhatsApp conversation with the seller's phone number — so your number is shared with the other party only when a conversation about a listing is deliberately started. Because contact takes place on WhatsApp, you can block any user directly in WhatsApp, and you can report them to us as well.
Reports, moderation and enforcement
Any user can report a listing, a showroom or another user from within the app. We review reports and, where a breach is found, remove the content, suspend the account, or close it permanently — typically within 24 hours for objectionable content or abusive users — without prejudice to our other rights. Repeated or serious breaches lead to a permanent ban.
Intellectual property
The Tork name, logo, and the design, text, graphics and software of the app and website are owned by ALFADHA SHOP and protected by law. You may not copy them, or use the Tork mark or any confusingly similar mark, without our written permission. This does not cover content posted by users, which remains owned by them.
Free Platform Usage
Using Tork and posting listings on the app is free of charge. Tork does not require or process in-app payments or credit card transactions.
Disclaimer
The app is provided "as is", with no express or implied warranty as to the accuracy of user-posted content, the quality or fitness of any item, or uninterrupted availability of the service. Always inspect the item and verify the other party before paying.
Limitation of liability
To the fullest extent permitted by law, Tork is not liable for loss arising from a transaction between users, from content posted by a user, or for lost profit or data. Nothing here excludes liability that cannot lawfully be excluded.
Deleting your account and ending use
You can delete your account at any time — in the app from My Account → More → Delete account, on the web at https://torkiq.net/delete-account, or by emailing [email protected] from your registered number. When you delete your account, your profile details and active listings are immediately removed from our active databases and your access ends. This cannot be undone. We retain only minimal security and moderation audit records after deletion, strictly where required to meet our legal obligations under Iraqi law or to prevent fraud. We may also end your access to the service if you breach these terms.
Changes to these terms
We may amend these terms. The updated version will appear here with a new "last updated" date, we will also notify you inside the Tork mobile app, and continuing to use the app after that means you accept it.
Governing law
These terms are governed by the laws of the Republic of Iraq, and the courts of Baghdad have jurisdiction over any dispute arising from them.
